These Service Terms and Conditions (“Agreement”) regulate the terms of use for web hosting, reseller hosting, dealer hosting, virtual servers (VDS/VPS), physical servers (Dedicated Server), cloud infrastructure services, network, backup, licensing, digital products and all related additional services provided by ServerTurk Bilişim Teknolojileri (“ServerTurk”).
Any real or legal person who places an order, uses, pays for or benefits in any way from ServerTurk services will hereinafter be referred to as the “Customer”. By placing an order, making a payment, using the service or electronically approving this Agreement, the Customer declares that they have read, understood and accepted the entire Agreement.
1. Definitions 1.1. Service: All hosting, server, network, license, digital product and related technical services provided by ServerTurk. 1.2. Digital Product / Digital License: All products such as licenses, keys, access, account definitions etc. that are delivered electronically, activated or granted usage rights without physical delivery. 1.3. Infrastructure Provider / Upstream Provider / Third Party Provider: Data centers, network operators, server hosting companies, license manufacturers, panel providers, software manufacturers, payment institutions or other third parties that ServerTurk cooperates with. 1.4. Abuse / Complaint: Notifications regarding illegal activities, spam, attacks, copyright infringement, fraud, unauthorized access, misuse or violation of third party rights. 1.5. Traffic Data / Log: Connection, access, transaction and usage records generated within the systems that ServerTurk actually accesses, operates or technically controls.
2. Subject and Scope of the Agreement 2.1. This Agreement regulates the terms of use of the services offered by ServerTurk, the rights and obligations of the parties, service limitations, liability limits and sanctions. 2.2. ServerTurk reserves the right to change the scope of services, technical specifications, plan contents, prices, limits, delivery methods and operational procedures when deemed necessary. 2.3. All policies published on the ServerTurk website (Acceptable Use Policy, SLA/Uptime Policy, Security Policy, Payment Policy, Fraud Prevention Policy, DMCA/Abuse Policy etc.) are an integral part of this Agreement.
3. General Provisions 3.1. ServerTurk services are provided “as is” and “as available”. 3.2. ServerTurk does not guarantee that the services will always be uninterrupted, error-free, delay-free, data-loss-free or fully compatible with all software. 3.3. The Customer is obliged to evaluate the compatibility of the purchased service with their own intended use, software structure, traffic type, system requirements and third-party integrations. 3.4. ServerTurk may change, restrict, suspend or terminate the service due to technical requirements, security, infrastructure, maintenance, abuse, payment risk, fraud suspicion or operational necessities. 3.5. ServerTurk reserves the right to make changes to IP address, network topology, server location and other technical components without prior notice.
4. Order, Verification and Delivery 4.1. ServerTurk has the right to review orders manually or automatically based on security, payment, identity, risk and fraud criteria. 4.2. Additional verification (ID verification, documents, purpose statement etc.) may be requested for suspicious orders. 4.3. ServerTurk reserves the right to reject, cancel or refund any order without stating a reason. 4.4. Delivery times are not guaranteed. Delays may occur due to manual review, stock, third-party providers, licensing or technical maintenance.
5. Payment, Invoicing, Renewal and Delay (Sections 5.1 to 5.6 remain the same as in the Turkish version – standard payment and renewal rules.)
6. Refund, Cancellation and Withdrawal 6.1. ServerTurk reserves the right to refuse refunds for digital products, licenses, activated services and custom works in accordance with applicable law. 6.2. Once a digital license or service is delivered/activated, refunds are not granted as a rule. 6.3. Customer misunderstanding, unmet expectations or change of mind are not valid grounds for refund. 14. Abuse, DMCA and Complaint Processes 14.1. ServerTurk has the right to evaluate abuse, copyright and illegal activity notifications. 14.2. ServerTurk may suspend or terminate the service without prior notice when necessary. 14.3. The Customer must respond to abuse notifications in a timely and satisfactory manner. 14.4. ServerTurk may take quick action to reduce risk without making a final legal judgment.
14.5. Complaints on Public Platforms and Protection of Commercial Reputation
The Customer agrees to first seek resolution through ServerTurk’s official support channels (email, ticket system, live support) for any dispute that may arise.
The Customer agrees not to publish complaints containing false, incomplete or exaggerated statements that would damage ServerTurk’s commercial reputation on public platforms (Şikayetvar, Twitter/X, Facebook, Ekşi Sözlük, forums etc.), especially regarding digital licenses, FiveM keys and additional services.
In the event of any complaint, the Customer is obliged, upon ServerTurk’s request, to mark the complaint as “resolved” or remove it from the platform.
In case of violation of this clause, ServerTurk shall have the right to:

17. Limitation of Liability 17.1. ServerTurk shall not be liable for loss of profit, revenue, data, customers, reputation or any indirect/consequential damages. 17.2. ServerTurk’s total liability in any dispute is limited to the amount actually paid by the Customer for the relevant service in the last billing period.

20. Right to Amend 20.1. ServerTurk may update this Agreement, policies, prices and terms at any time. 20.2. Updated terms become effective upon publication on the website.
21. Governing Law and Jurisdiction 21.1. This Agreement is governed by the laws of the Republic of Turkey. 21.2. Disputes shall be resolved by the Courts and Enforcement Offices of Kahramanmaraş, without prejudice to mandatory consumer protection provisions.
